TERMS OF USE

1. Acceptance and legal effect

By accessing, browsing, registering for, submitting information through, or otherwise using OneClickDrive.ma or a related interface (the “Platform”), you agree to these Terms of Use to the extent legally applicable to your activity. If you do not agree, you must not use the Platform.

For these Terms, “OneClickDrive”, “we”, “us” or “our” means the legal entity identified as operator of OneClickDrive.ma in the website Legal Notice. References to “Supplier” mean an independent car-rental company or other independent mobility provider using the Platform. The Legal Notice, Privacy Policy and any additional terms expressly presented for a feature or transaction are incorporated by reference where applicable.

Electronic acceptance, checkboxes, one-time passwords, booking confirmations, emails, WhatsApp confirmations and other electronic records may be used as evidence of instructions, acceptance or transactions to the extent permitted by Moroccan law.

2. Eligibility and authority

You must be at least 18 years old and legally capable of entering into binding obligations to create an account, submit a booking request or use transactional features. Vehicle rental may be subject to a higher minimum age, minimum licence-holding period, payment-card, deposit, residency or other criteria imposed by the selected Supplier or applicable law.

If you use the Platform for or on behalf of a company, rental business or other organization, you represent that you have authority to bind that organization in relation to the use you undertake.

3. What OneClickDrive is — and is not

OneClickDrive operates a digital marketplace, advertising, lead-generation and booking-intermediation platform. It allows users to discover vehicle-rental offers, request quotations, communicate with rental Suppliers and, for certain bookings, pay a booking amount through a payment method made available by OneClickDrive.

Unless a specific transaction expressly states otherwise, OneClickDrive is not the owner, keeper, manufacturer, repairer, insurer or lessor of the advertised rental vehicles and is not the employer of Supplier personnel. The Supplier is an independent business and is the contracting rental party responsible for the vehicle, the rental agreement, delivery/handover, legally required insurance, roadworthiness, maintenance, deposits, rental performance and charges arising under its rental contract.

OneClickDrive may facilitate communications, collect a booking amount, assist with a complaint, monitor Supplier quality or provide a goodwill solution without becoming a party to the underlying vehicle-rental contract and without assuming the Supplier’s obligations.

4. Listings, quotations and availability

Vehicle descriptions, prices, images, availability, included mileage, deposits, insurance/excess information, delivery conditions and other listing details are supplied or confirmed by Suppliers, although OneClickDrive may format, translate, review, enrich or moderate that information. Suppliers are responsible for keeping their information accurate and current.

A listing or search result is not by itself a guaranteed offer or confirmed reservation. Availability and price can change until a booking is accepted and confirmed. Any material rental condition that affects the final price or use of the vehicle should be disclosed before confirmation or, where it is a post-rental charge such as a traffic fine, in the Supplier’s rental agreement.

OneClickDrive may correct typographical, technical or manifest pricing errors. If a material error is discovered after a booking request but before performance, OneClickDrive may offer the correct terms or cancel the affected booking and arrange a refund of any amount it controls, without limiting any non-waivable right you may have under applicable law.

5. Search results, ranking and promoted placement

Search order and recommendations may be determined by a combination of relevance, city/location, requested dates, vehicle category, availability, price competitiveness, Supplier response time, booking history, customer feedback, quality/compliance indicators, cancellation or fulfilment history, account status and other factors intended to improve matching and platform reliability.

Commercial arrangements with Suppliers — including subscription level, sponsored placement, promotional participation or other paid visibility — may also affect prominence where the Platform offers those features. OneClickDrive may distinguish or label promoted content where required by law or where necessary to avoid misleading users. No Supplier is guaranteed a particular search position, lead volume, booking volume or revenue unless expressly agreed in a separate written commercial agreement.

6. Accounts, verification and security

• Provide information that is accurate, current and not misleading, and promptly update material changes.
• Keep passwords, one-time codes and account access confidential; do not allow unauthorized users to impersonate you.
• Notify OneClickDrive promptly if you suspect account compromise, fraudulent communication or unauthorized activity.
• Complete reasonable identity, eligibility, fraud or business-verification checks where required for a transaction or Supplier account.

You are responsible for activity carried out through your account or verified communication channel to the extent that the activity results from your act, omission or failure to use reasonable security. This does not exclude OneClickDrive’s liability where an unauthorized transaction is legally attributable to OneClickDrive.

7. Acceptable use

You may use the Platform only for lawful purposes and in accordance with these Terms. You must not, directly or indirectly:

• submit fake, speculative, abusive or fraudulent rental enquiries, bookings, payment disputes, reviews or identity documents;
• use robots, scraping tools, crawlers, automated extraction, browser automation or other means to copy, harvest or systematically collect listings, prices, user data, Supplier data or database content without written authorization;
• reverse engineer, decompile, probe, overload, disrupt or attempt to bypass security, rate limits, access controls, anti-fraud systems or technical restrictions;
• use Platform data to create or train a competing database, marketplace, price-monitoring service, model or commercial product without OneClickDrive’s written permission;
• introduce malware, malicious code, credential-harvesting links or other harmful material;
• impersonate another person or business, misrepresent affiliation, or use false contact or payment information;
• harass, threaten, discriminate against, defame or unlawfully pressure users, Suppliers or staff;
• circumvent a lawful fee, booking attribution, account restriction or commercial term by creating alternate accounts or manipulating contact information; or
• use the Platform in a way that violates applicable law, intellectual-property rights, privacy rights, consumer rights or third-party contractual rights.

8. User content, reviews and communications

If you submit a review, photograph, message, complaint, business logo, listing material or other content (“User Content”), you retain any ownership you lawfully have, but grant OneClickDrive a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, translate, display, distribute and use that content for operating, promoting and improving the Platform, subject to the Privacy Policy where the content contains personal data.

You represent that you have the rights and permissions necessary to submit User Content and that it is accurate to the best of your knowledge, not unlawful, not misleading, not defamatory, not a privacy violation and not submitted in exchange for an undisclosed improper benefit.

OneClickDrive may moderate, refuse, edit for formatting, limit visibility of or remove User Content that reasonably appears to violate these Terms, applicable law or platform integrity. Moderation is not an endorsement and does not create a general duty to pre-screen all content. Legitimate negative feedback is not prohibited merely because it is unfavorable.

9. Supplier and advertiser content

Supplier pages, advertisements, fleet details and offers are provided by independent businesses. OneClickDrive may conduct onboarding, document checks, quality scoring, sampling or complaint reviews, but any such activity is a platform-control measure and not a guarantee that every Supplier, vehicle, document, statement or transaction has been independently verified at all times.

If OneClickDrive becomes aware of credible safety, fraud, legal, consumer-protection or repeated fulfilment concerns, it may investigate and may suspend, restrict, de-rank or remove the relevant Supplier or listing while the matter is reviewed.

10. Intellectual property and database rights

The Platform, its software, interface, original text, graphics, logos, trademarks, database structure, selection and arrangement of content, and other OneClickDrive materials are owned by or licensed to OneClickDrive and are protected by applicable intellectual-property laws. Except for the limited right to use the Platform for its intended purpose, no licence is granted to reproduce, republish, sell, scrape, distribute, modify or commercially exploit those materials.

Supplier trademarks and third-party vehicle marks remain the property of their respective owners. Their appearance on the Platform does not imply manufacturer endorsement of OneClickDrive.

11. Third-party services and links

The Platform may integrate or link to maps, messaging services, payment gateways, analytics providers, social networks or Supplier websites. Those services are operated by third parties and may have separate terms and privacy practices. OneClickDrive is not responsible for a third party’s independent service, outage, content or data handling except to the extent liability is imposed on OneClickDrive by mandatory law.

12. Electronic communications

You agree that OneClickDrive may communicate electronically regarding enquiries, bookings, payments, security, support cases and account administration using the contact details you provide. A message sent through an official OneClickDrive channel may form part of the transaction record. Promotional communications remain subject to the Privacy Policy and applicable marketing-consent rules.

13. Platform availability, updates and changes

OneClickDrive may add, remove or change Platform features, interfaces, ranking methods, eligibility controls or technical providers and may conduct maintenance or respond to outages or security incidents. We do not promise uninterrupted or error-free availability. For an already confirmed paid booking, a platform change will not by itself remove rights already acquired under the booking terms or mandatory law.

14. Suspension and termination

OneClickDrive may suspend or restrict an account, enquiry, listing, Supplier profile or access to the Platform when reasonably necessary to investigate suspected fraud, protect users or systems, respond to legal requirements, enforce these Terms, address unpaid commercial fees, prevent abuse or manage significant safety/quality concerns. Where appropriate and legally required, we will provide notice or an opportunity to remedy before permanent action.

Termination does not affect payment obligations, rights, remedies, evidence or provisions that by their nature are intended to survive, including intellectual-property, confidentiality, liability, indemnity, dispute and record-retention provisions.

15. Disclaimers

To the fullest extent permitted by applicable law, the Platform and general informational content are provided on an “as available” basis. OneClickDrive does not warrant that every listing will always be error-free, that every Supplier will accept a request, or that a particular vehicle will remain available before confirmation.

OneClickDrive does not provide legal, insurance, mechanical or financial advice through ordinary listing content. Users must review the Supplier’s rental agreement and ask questions about insurance, excess, deposit, mileage, fuel, permitted drivers, geographic limits and other material rental conditions before accepting the vehicle.

16. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from OneClickDrive’s fraud, wilful misconduct or gross negligence, or any mandatory consumer right. Any exclusion or limitation in these Terms applies only to the extent permitted by Moroccan law.

Because the Supplier is the independent vehicle lessor, OneClickDrive is not responsible for losses caused solely by the Supplier’s vehicle condition, mechanical failure, maintenance, insurance performance, driving incident, road accident, deposit administration, fines, delivery conduct, rental-contract breach or other act or omission in performing the underlying rental, except to the extent a loss is legally attributable to OneClickDrive’s own act or omission.

To the extent permitted by law, OneClickDrive is not liable for indirect, incidental, special or consequential commercial loss, loss of profit, loss of business opportunity or loss of data that was not a reasonably foreseeable direct result of OneClickDrive’s breach. Consumers retain all non-waivable remedies available under applicable law.

For a user acting in the course of business, profession or trade, OneClickDrive’s aggregate liability arising from use of the Platform in any twelve-month period will, to the fullest extent permitted by law, not exceed the total fees that user actually paid directly to OneClickDrive for the affected Platform services during that period. This business-user cap does not apply to liability that Moroccan law prohibits the parties from limiting.

17. Indemnity for unlawful or business use

A business user, Supplier or advertiser will indemnify OneClickDrive against third-party claims, regulatory costs, chargebacks and reasonable losses arising from that party’s unlawful content, infringement, fraud, data misuse, breach of these Terms or breach of its own obligations to a customer, except to the extent caused by OneClickDrive’s own legally attributable misconduct. A consumer is responsible only to the extent permitted by applicable law for loss caused by the consumer’s unlawful or fraudulent misuse of the Platform.

18. Force majeure

Neither party is responsible for delay or failure caused by events beyond its reasonable control to the extent recognized by applicable law, including major network or cloud failures, natural disasters, governmental restrictions, widespread transport disruption, war, civil disturbance, epidemic, cyberattack by a third party or failure of critical infrastructure. Payment already received for a service that cannot lawfully be retained will be handled in accordance with applicable law and the relevant booking terms.

19. Severability, no waiver and assignment

If a provision is held invalid or unenforceable, it will be applied to the maximum lawful extent and the remaining provisions will continue where they can operate independently. A delay in enforcing a right is not a waiver of that right. OneClickDrive may transfer these Terms as part of a lawful reorganization, financing or transfer of the Platform business, provided that doing so does not remove mandatory consumer rights. Users may not transfer an account or commercial rights without consent where the transfer would materially affect OneClickDrive or a Supplier.

20. Moroccan law and disputes

These Terms are governed by the laws of the Kingdom of Morocco, without prejudice to any mandatory law that must apply to a consumer. The parties should first attempt to resolve a dispute through the support or complaint process published on OneClickDrive.ma. If no solution is reached, disputes may be brought before the courts having jurisdiction under Moroccan law. Nothing in these Terms deprives a consumer of a mandatory right to bring a claim before another competent court or authority.

21. Changes to these Terms

OneClickDrive may update these Terms for future use of the Platform. The latest version and effective date will be published on OneClickDrive.ma. A material change will not retroactively rewrite the essential commercial terms of an already confirmed booking unless the change is required by law or expressly accepted by the affected user.

22. Contact and legal information

The operator’s legal identity, registered office, company identifiers and official contact channels are published in the Legal Notice on OneClickDrive.ma. Questions about a specific booking should include the booking reference and be sent through an official OneClickDrive contact channel.

These Terms of Use govern access to the Platform. Vehicle-rental bookings are additionally subject to the Booking & Marketplace Terms and Conditions and the selected Supplier’s rental agreement.
